End User License Agreement (EULA)

Operator: Ascend Performance Nutrition / Sutton Huggins

1. Acceptance

By downloading or using RailChase you agree to this EULA. If you do not

agree, do not use the app.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to

use RailChase for personal, non-commercial railfan activity. You may not

copy, modify, distribute, reverse-engineer, or create derivative works of the

app.

3. User-Generated Content

3.1 Your responsibility

You are solely responsible for any content you submit (photos, text,

coordinates). Do not submit content that is:

  • illegal, defamatory, harassing, or threatening
  • sexually explicit or violent
  • not related to trains or railroads
  • a violation of any third party's intellectual property or privacy rights

    • 3.2 Our moderation rights

    We may remove any content at any time for any reason, with or without notice.

    The automated moderation system screens photos at submission time. Users may

    report content via the in-app report button. Content that receives 3 or more

    reports is automatically hidden pending review.

    3.3 License to us

    By submitting content you grant us a worldwide, royalty-free license to store,

    display, and distribute that content as part of the community sightings board.

    This license ends when the content is removed (typically after 48 hours).

    4. Prohibited uses

    You may not use RailChase to:

  • interfere with or circumvent rate limits or security controls
  • submit false, misleading, or fabricated sightings
  • scrape or bulk-download board data
  • use automated tools to submit sightings
  • trespass on railroad property

    • 5. Disclaimer of warranties

    RailChase is provided "as is" without warranties of any kind. We do not

    warrant that the app will be error-free, uninterrupted, or that live train

    positions are accurate. Live positions come from public GTFS-RT feeds and may

    be delayed or incorrect. Do not rely on this app for safety-critical decisions.

    6. Limitation of liability

    To the maximum extent permitted by law, we are not liable for any indirect,

    incidental, special, or consequential damages arising from your use of the app.

    Our total liability for any claim is limited to USD $10.

    7. Termination

    We may terminate or suspend your access to the app at any time if you violate

    this EULA. Sections 3, 5, 6, and 8 survive termination.

    8. Governing law

    This EULA is governed by the laws of the state of GOVERNING_LAW_STATE (set before launch), USA, without

    regard to conflict-of-law principles.
